Subject: Your letter of April 13, 1998

Good morning:

At the onset I must regrettably inform you that I received your letter of 4/13/1998 on 4/16/1998 as validated by the registered receipt that accompanied your certified letter. On 4/15/1998 the enclosed letter directed to the U.S. Office of Special Counsel was mailed.

Frankly, your assertion in the 4/13/1998 letter that “we were unable to reach you or the postmaster of MyMail. . .” lacks credibility. In fact, enclosed is a copy of an E-mail message from Harlan Gottlieb, Command Counsel for U.S. Army STRICOM, to the e-mail address that includes your E-mail address of dated 13 Nov 1997. I suggest you provide me a copy of any “bounced mail” error message you may have received. As I doubt that you will provide such documentation and as I believe your behavior constitutes capricious withholding of information I have amended my lawsuit against the U.S. Government in the U.S. District Court for Maryland to include your office.

The following AMENDS my orginal FOIA request of 3/13/1998.

As stated to your office in numerous other Freedom of Information Act (FOIA) requests I agree to pay for all search and duplication costs as a non-commercial requester.

Enclosed please find my letter of 9/29/1996 to Robin Scott, Administrative Contracting Officer for contract no. N61339-92-D-0018. I request a copy of her position description, i.e. GS-1105-9 or whatever.

This description should list all her duties as an Administrative Contracting Officer.

Enclosed please find my letter of November 6, 1997 requesting an interview with Robin Scott. I direct your attention to para. (3)(a)(2). I request copies of the statement of work for contract no. N61339-95-D-0006; specifically documents related to the construction of “EDI watch! User’s Manual” created June 1996 by TASC employee Mr. Harvey A. Meier. Also I request a copy of the monthly progress reports delivered on this contract between June 1996 and September 1996.

On August 20, 1997 a notice appeared in the Commerce Business Daily [site W-232 SN112537] regarding solicitation no. N61339-97-R-0047 for Non-Personal Support Services. Please provide a copy of the vendor’s list of all firms that responded with information, brochures or letters of interest regarding this procurement. It is believed that the follow-on contract to this solicitation was awarded to Litton PRC, please provide a copy of the statement of work and all Standard Form 30s or 33s issued against this contract. Additionally, I understand that Mr. Kim Denver is the Contracting Officer or Administrative Contracting Officer on this contract. Please provide a copy of his position description; i.e. GS-1104-9 or whatever, a description that includes his duties and responsibilities.

Thank you for your assistance in this matter. I have sumbitted an affidavit under the penalties of perjury to the U.S. District Court that I have successful received dozens of electronic messages to E-mail address between March 13, 1998 and April 13, 1998. Therefore, I suggest you attempt to use this e-mail form of communication if you require clarification.
